2025-2026 INSURANCE UPDATE

On July 9, 2025 Brian Kalmensen the insurance agent for the Association did a presentation for the membership on how the Association insurance policy works verses how an individual owner’s policy works. Below is a simple exert from Brian on the presentation:

  • Post-Loss Actions. The association’s broker specified that the owners’ insurance remains the first defense for unit interior damages after a loss event, irrespective of whether the loss originates in the unit or common area. With the property deductible being $50,000 per unit for water damage, owners’ policies will be the first policy involved for unit interior damages, and if the owners’ insurance companies determine that the damages exceed the association’s deductible, they will request a claim be made on the association’s policy for review.
  • Owners’ Insurance Obligations. While the association’s insurance policy covers the unit interior finishes as originally installed by the developer (including developer-installed upgrade options at the time of purchase), the association’s master property policy has a $50,000 per unit water damage deductible. All owners should make sure that, even if their homes are original, that they are carrying adequate coverage for the deductible, as well as any other property not insured by the association (unit-owner upgrades, personal contents, etc.)
  • Loss of Use. All owners need to carry ‘Loss of Use’ coverage on their policies, as California Civil Code 4775 specifies that, if owners need to be relocated following a loss, the relocation expenses are borne by the owners. Loss of Use coverage provides protection for this.
  • Sewer & Drain Backup. It was advised that the most common type of loss that happens in high-rises is a plumbing backup. Owners should make sure that their policies cover backup & overflow coverage, particularly given the association’s $50,000 per unit water deductible.
  • Personal Liability. All owners are required by the CC&Rs to carry at least $500,000 per occurrence / $1,000,000 aggregate in personal liability coverage, which can respond in situations where an owner causes injury or property damage to others due to their actions/inactions (i.e. bath tub overflow that causes damage to several homes below, hitting a fire sprinkler head and causing discharge, etc.)

As of July 18th, 2025, the large trash room door facing the parking spaces will remain closed at all times. Keeping the door closed helps maintain the AC efficiency and supports ongoing efforts to prevent odors and pests.

PROPER BALCONY CLEANING

Please be reminded that when cleaning your balcony or deck, care must be taken to ensure that no water, debris, or cleaning solutions extend beyond the boundaries of your private area.

As outlined in Section 4.2.7 of the Residential Handbook, all balcony cleaning must be done in a controlled manner that prevents any runoff or dripping onto neighboring units or common areas.

Residents are responsible for any damage or disturbance caused by water or items falling from their balcony.
